I just found out yesterday that the courts have placed a PPO against my fiancee, so that he cannot have contact with me. This was supposed to have been resolved back in November when I went to court. We had been arguing and somebody called the cops and he got arrested for domestic violence. There was no physical abuse of any kind. When I went to court the judge asked me if I wanted to drop the PPO, and I said YES. I didn’t know it was there to begin with. But when I go to bail him out of jail they say that I can’t because I have a PPO against him. Should I just have somebody else see if they can bond him out, or try to go through all the legal things just to get him out of jail, which will take forever. Plus I am nine months pregnant, and don’t want him to miss the birth of our child, which will be any day now.

File an emergency motion to Lift Personal Protection Order. If you do not have a lawyer, walk it up to the Judge’s office after it is filed with the Court clerk. The motion should say why you feel safe to have the Order lifted. It was entered to protect you, so the Motion should say why you do not need the protection. The Order is short and simple. It just needs to say: “Petitioner Jane Smith has filed a motion to lift the Personal Protection Order barring ‘John Smith’ from contact with her. The Court, being fully advised, finds the Motion is well taken and is hereby granted.” Judge signs, you go back to the Court Clerk and file it and get an extra copy stamped for yourself. The Motion needs to be more detailed. I hope you’re doing the right thing. You needed protection against him once–hope you don’t again. If this is what you want to do, you should concentrate on the paperwork for the Court and let someone else bail him out of jail.
